9 Tribal Council (DAS) Follow up SK Bupati of Jayapura

The district Government of Jayapura jointly signed a memorandum of understanding with 9 Tribal Councils (Dewan Adat Suku/DAS), following decree of the regent (SK) no. 319 and decree no. 320 of 2014, respectively on the Recognition and Protection of Indigenous Peoples Law' and ‘the Establishment of indigenous villages in the district of Jayapura'. NGOs Samdhana and Pt PPMA Papua, which oversees the strengthening of indigenous peoples in Papua, also signed the MoU.

Signed in Jayapura on 29 April 2015, the agreement is a result of the Workshop on "Building and Strengthening Implementation Paradigm Recognition and Protection of Indigenous Peoples After the issuance of SK Bupati No. 319 and 320 2014". The workshop was held by a cooperation of the Jayapura Regency Government, the Association for Assessment and Empowerment of Indigenous Peoples Papua (Pt PPMA) together with the joint team Samdhana Institute, Epistema Institute, Huma and JKPP. The agreement contains three points of agreements and recommendations:

The Proposal for the establishment of an Indigenous Village is constitued as a right from the indigenous people law. The leaders of the indigenous villages are Ondoafi or other rightfuls. Act No. 6 2014 on the village states that the term of office of the leader or head of the indigenous village is 6 years. Altough Tthe traditional leadership structure with all ondoafian systems or other systems do not recognize customary tenure periods, unless the Ondoafi had died and or too old in which case the position was to be transferred to the eldest son.

Eleven recommendations were submitted, including updating the Indigenous People Law profile of 9 Tribal Councils (DAS), in a comprehensively standardized format. This profile will be a baseline for drafting local regulations and will support the development and monitoring of the Indigenous People Law. It was also proposed to have a verification committee that would be represented by various parties such as: indigenous peoples, the local government, academics, and NGO's which are stated in the decree of the regent (SK).

As a follow-up on Regent Decree No. 319/2014, it is proposed that a draft of Regional Regulation (Perda) on the Recognition of Indigenous People Law will be constructed.

This recommendation also agreed to the terms of changing the status of villages to traditional villages, according Regent Decree No. 320/2014. The expectation of impementing traditional villages is consistent with the tradition that respects nature as giver of livelihood, as disclosed by Yehuda Demetouw, chairman of DAS Tepra.
